Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Katharos platform and services ("Service"). This AUP is incorporated into and forms part of our Terms of Service.

By using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your access to the Service.


Permitted Uses

The Service is designed for legitimate compliance, due diligence, and investigation purposes. You may use the Service to:

  • Screen customers, counterparties, and business partners for sanctions and AML compliance
  • Conduct know-your-customer (KYC) and customer due diligence (CDD)
  • Investigate entities and individuals for legitimate business or legal purposes
  • Generate compliance reports and documentation
  • Monitor sanctions lists and regulatory changes
  • Research beneficial ownership structures
  • Conduct enhanced due diligence on high-risk relationships

Prohibited Uses

You may NOT use the Service for any of the following purposes:

Illegal Activities

  • Sanctions Evasion: Using the Service to evade, circumvent, or facilitate evasion of sanctions or export controls
  • Money Laundering: Using the Service to launder money or facilitate money laundering
  • Terrorist Financing: Using the Service to finance terrorism or support terrorist organizations
  • Fraud: Using the Service to commit or facilitate fraud, identity theft, or financial crimes
  • Other Crimes: Using the Service to violate any applicable law or regulation

Harmful Activities

  • Harassment: Using screening results to stalk, harass, threaten, or harm any individual
  • Discrimination: Using the Service to discriminate against any individual or group in violation of law
  • Doxxing: Using the Service to expose private information about individuals for malicious purposes
  • Personal Vendettas: Screening individuals for personal, non-business purposes without legitimate basis

Consumer Reporting Violations

  • FCRA Violations: Using the Service as a "consumer report" under the Fair Credit Reporting Act
  • Employment Screening: Using the Service to make employment decisions without proper compliance
  • Credit Decisions: Using the Service to make consumer credit decisions
  • Tenant Screening: Using the Service for tenant screening without proper procedures
  • Insurance Decisions: Using the Service for insurance underwriting decisions on consumers

IMPORTANT: Katharos is NOT a consumer reporting agency. If you need to conduct background checks on individuals for employment, credit, housing, or insurance purposes, you must use a compliant consumer reporting agency and follow all FCRA requirements.

Security Violations

  • Unauthorized Access: Attempting to access accounts, systems, or data without authorization
  • Interference: Interfering with or disrupting the Service or related infrastructure
  • Malware: Transmitting viruses, malware, or other harmful code
  • Reverse Engineering: Reverse engineering, decompiling, or disassembling the Service
  • Circumvention: Circumventing security controls or access restrictions

Abuse of Service

  • Automated Abuse: Using bots, scrapers, or automated tools to access the Service without authorization
  • Excessive Use: Using the Service in a manner that burdens infrastructure or degrades performance for others
  • Reselling: Reselling, sublicensing, or redistributing the Service without authorization
  • Misrepresentation: Misrepresenting your identity, affiliation, or purpose for using the Service
  • Data Harvesting: Systematically collecting data from the Service for unauthorized purposes

Misuse of AI Features

  • Prompt Injection: Attempting to manipulate AI features through prompt injection or similar techniques
  • Jailbreaking: Attempting to bypass AI safety measures or content policies
  • Generating Harmful Content: Using AI features to generate illegal, harmful, or misleading content
  • Misrepresenting AI Output: Presenting AI-generated content as human-generated without disclosure

Your Responsibilities

When using the Service, you are responsible for:

Compliance

  • Ensuring your use complies with all applicable laws and regulations
  • Maintaining any required licenses, registrations, or authorizations
  • Following your organization's internal compliance policies
  • Consulting with legal counsel as needed

Verification

  • Verifying the accuracy of screening results before relying on them
  • Not treating AI-generated analysis as a substitute for human judgment
  • Conducting additional due diligence when warranted
  • Documenting your compliance decisions appropriately

Data Protection

  • Processing personal data in compliance with privacy laws
  • Providing required notices and obtaining necessary consents
  • Implementing appropriate security measures for data you export
  • Reporting any suspected data breaches promptly

Account Security

  • Keeping your login credentials confidential
  • Using strong, unique passwords
  • Enabling multi-factor authentication when available
  • Reporting any unauthorized access immediately

Reporting Violations

If you become aware of any violation of this AUP, please report it to:

We will investigate reports promptly and take appropriate action.


Enforcement

Investigation

We reserve the right to investigate suspected violations of this AUP. We may:

  • Review usage patterns and logs
  • Suspend access pending investigation
  • Cooperate with law enforcement as required

Consequences

Violations of this AUP may result in:

  • Warning and request for corrective action
  • Temporary suspension of access
  • Permanent termination of access
  • Reporting to law enforcement
  • Legal action to recover damages

Appeals

If you believe enforcement action was taken in error, you may appeal by contacting patrick@katharos.co within 30 days.


Changes to This Policy

We may update this AUP from time to time. We will notify you of material changes by posting the updated policy and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
